This page is a strong plain-English Terms of Service template for Sykeke Learning Academy, but it is not a substitute for advice from a licensed attorney. Because this business serves children, uses live online platforms, and sells education products, Sykeke, LLC should have this reviewed by a Washington business attorney before publishing.
1. Acceptance of These Terms
These Terms of Service (“Terms”) govern your access to and use of SykekeAcademy.com, Sykeke Learning Academy webpages, class information, curriculum previews, downloadable resources, product listings, staff or teacher information, communications, and related education services operated by Sykeke, LLC (“Sykeke,” “Sykeke Learning Academy,” “we,” “us,” or “our”).
By visiting our website, contacting us, enrolling a learner, joining a waitlist, attending a class, purchasing or downloading materials, using our links, or allowing a child to participate in our services, you agree to these Terms. If you do not agree, please do not use our website, services, products, downloads, or class links.
If you use our services for a child, family, school, homeschool, co-op, organization, or other person, you confirm that you have authority to accept these Terms on their behalf.
2. Education Business Scope
Sykeke Learning Academy is an online education-focused business. We may advertise, provide, showcase, or link to services and products including full-year supplemental online classes, private tutoring, early elementary curriculum support, Minecraft gaming clubs, parent resources, teacher resources, worksheets, printable files, digital downloads, merchandise, staff information, and related educational content.
Some offerings may be hosted directly by us, and some may be offered through third-party platforms such as Outschool, Teachers Pay Teachers, Etsy, video platforms, payment processors, social media websites, or other providers. We may update, remove, rename, reprice, discontinue, pause, reschedule, or change services and products at any time, subject to applicable law and any platform rules that apply.
3. Not an Accredited School or Legal Homeschool Authority
Sykeke Learning Academy is an independent educational enrichment provider and is not an accredited public or private school. We provide supplemental education, tutoring, and homeschool support.
Unless clearly stated in a separate signed written agreement, we are not a daycare, childcare provider, therapy provider, medical provider, special education evaluator, or legal homeschool compliance service.
Parents and guardians are responsible for determining whether our services, classes, materials, and schedules meet their child’s needs and any homeschool, school, district, state, or family requirements. We do not guarantee grade promotion, test results, reading level gains, academic outcomes, social outcomes, college readiness, school compliance, or any specific educational result.
4. Third-Party Platforms
Sykeke Learning Academy may use or link to third-party platforms, including but not limited to Outschool, Teachers Pay Teachers, Etsy, Zoom or other video tools, payment processors, email providers, hosting providers, social media platforms, shipping providers, and game-related services.
When you enroll, buy, download, message, attend, pay, review, or interact through a third-party platform, that platform’s own terms, privacy policy, refund rules, community standards, account rules, payment rules, and safety policies also apply. We do not control those platforms and are not responsible for their outages, payment issues, account decisions, refunds, moderation decisions, listing removals, technical problems, data practices, shipping issues, or policy enforcement.
Platform separation: Purchases, enrollments, refunds, and account issues handled by Outschool, Teachers Pay Teachers, Etsy, or another third party may need to be resolved through that third party’s support system.
5. Parents, Guardians, and Minors
Our services may be designed for children and minors. A parent or legal guardian is responsible for reviewing each class, club, product, resource, schedule, technology requirement, and platform policy before allowing a learner to participate or purchasing materials.
By enrolling a learner, purchasing child-focused resources, submitting learner information, joining a class, or allowing a child to participate, you confirm that you are the learner’s parent, legal guardian, or an authorized adult with permission to do so.
Parents and guardians are responsible for the learner’s home learning environment, device setup, internet connection, camera and microphone permissions, printing needs, game access, behavior, supervision outside the live class, and compliance with family rules and platform rules.
6. Classes, Tutoring, and Learning Clubs
Class descriptions, schedules, teacher names, enrollment availability, pricing, curriculum topics, worksheets, class lengths, age ranges, and learning goals are provided for general information and may change. Live classes and tutoring may vary based on learner needs, platform rules, class size, instructor judgment, learner participation, technology issues, or safety concerns.
Learners may need specific supplies, printed worksheets, software, accounts, devices, microphone access, camera access, game versions, or internet quality. You are responsible for checking requirements before class and for arriving on time. We are not responsible for missed instruction caused by late arrival, device issues, internet problems, unsupported software, incorrect game versions, platform outages, or family scheduling conflicts.
7. Minecraft and Gaming Clubs
Minecraft and gaming clubs are intended to provide supervised, age-appropriate social experiences. However, online gaming involves learner interaction, technology, usernames, third-party game accounts, platform rules, internet connections, and behavior that we cannot fully control.
Parents and guardians are responsible for ensuring learners have permission to use Minecraft or any other game, have the correct edition or version when required, follow class and server rules, use appropriate usernames and skins, and behave respectfully toward other learners.
We may remove, mute, restrict, or decline future participation for learners who disrupt the class, use inappropriate language, grief builds, bully others, share private information, bypass safety rules, use unauthorized mods or hacks, refuse instructions, or create safety concerns. Removal for conduct issues may not qualify for a refund.
Sykeke Learning Academy and Sykeke, LLC are not affiliated with, endorsed by, sponsored by, or officially connected to Microsoft, Mojang, Minecraft, Outschool, Teachers Pay Teachers, Etsy, or any other third-party brand unless expressly stated in writing.
8. Payments, Refunds, Cancellations, and Waitlists
Prices, availability, schedules, promotions, class listings, marketplace listings, shipping costs, taxes, and product details may change at any time. Many payments are handled by third-party platforms, and their refund, cancellation, transfer, credit, tax, dispute, and payment processing rules may control.
For Outschool classes, refunds, transfers, missed classes, recordings, cancellations, and enrollment issues are generally governed by Outschool’s policies and the specific class listing. For Teachers Pay Teachers, Etsy, merchandise, downloads, or other marketplace orders, the marketplace’s policies may apply.
We may choose to offer courtesy extensions, makeups, credits, waitlist priority, or support in some situations, but courtesy accommodations are not guaranteed and do not create a future obligation.
9. Curriculum, Digital Products, and Merchandise
Curriculum, worksheets, printables, lesson materials, guides, templates, teacher resources, parent resources, downloads, and similar materials are licensed, not sold, unless a listing clearly says otherwise. You may use purchased materials only as allowed by the product listing, marketplace terms, or written license.
Unless written permission is given, you may not resell, redistribute, upload, share publicly, give away, post in online groups, remove watermarks, claim as your own, include in competing products, use for mass distribution, or train artificial intelligence systems on our materials.
Digital downloads may be non-refundable once purchased, accessed, delivered, or downloaded, unless required by law or by the marketplace where the purchase occurred. Merchandise may be subject to separate shipping, return, production, print-on-demand, and carrier policies.
10. Conduct and Safety
Users, parents, guardians, and learners must act respectfully and safely. Prohibited conduct includes harassment, bullying, threats, discrimination, hate speech, sexual content, profanity directed at others, unsafe behavior, doxxing, sharing private information, unauthorized recording, impersonation, cheating, spam, disruption, and attempts to bypass safety systems.
We may contact a parent, remove a learner, report behavior to a platform, decline future service, restrict access, or take other reasonable action when behavior creates a learning, safety, privacy, legal, operational, or reputational concern.
11. Staff, Teachers, Tutors, and Future Instructors
Services may be provided by Sykeke Learning Academy owners, teachers, tutors, staff, contractors, affiliated instructors, substitute instructors, or platform-approved educators. Instructor availability, assignments, roles, and schedules may change.
Any instructor, teacher, tutor, contractor, or staff member affiliated with Sykeke Learning Academy must follow applicable platform rules, safety expectations, and business policies. However, users agree that Sykeke, LLC’s liability is limited as described in these Terms to the fullest extent permitted by law.
12. Intellectual Property
The Sykeke name, Sykeke Learning Academy name, logos, website design, graphics, text, images, icons, curriculum, worksheets, lesson structures, class materials, downloads, product listings, marketing content, videos, and other materials are owned by Sykeke, LLC or used with permission.
You may not copy, reproduce, modify, distribute, sell, publish, upload, create derivative works from, or use our intellectual property in a way that suggests ownership, endorsement, partnership, or affiliation without written permission.
13. Reviews, Testimonials, and Submissions
We may display reviews, testimonials, feedback, ratings, comments, or messages submitted publicly or provided to us, subject to platform rules and privacy obligations. We may edit testimonials for spelling, length, formatting, clarity, or presentation without changing the overall meaning.
Do not submit private learner information, sensitive details, photos, videos, or third-party content unless you have permission and are comfortable with us reviewing or using it for the purpose submitted.
14. Privacy
Our collection and use of information is described in our Privacy Policy. Because we may serve children, parents and guardians should review the Privacy Policy carefully before submitting learner information or allowing a child to participate.
15. Disclaimers
Our website, services, products, classes, downloads, and materials are provided “as is” and “as available” to the fullest extent permitted by law. We do not guarantee uninterrupted access, error-free content, perfect technology, specific learning outcomes, behavior outcomes, platform availability, marketplace availability, or that every resource will meet every learner’s needs.
Educational information is provided for general learning support and enrichment. It is not legal, medical, therapeutic, psychological, financial, special education, or professional advice.
16. Limitation of Liability and Indemnification
To the fullest extent permitted by law, Sykeke, LLC and its owners, instructors, staff, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost data, missed learning time, emotional distress, technology failures, platform issues, marketplace problems, or user conduct.
To the fullest extent permitted by law, our total liability for any claim related to our website, services, classes, products, downloads, or materials will not exceed the amount you paid directly to Sykeke, LLC for the specific service or product giving rise to the claim, or $100 if no direct payment was made to Sykeke, LLC.
You agree to defend, indemnify, and hold harmless Sykeke, LLC from claims arising from your violation of these Terms, misuse of our materials, learner conduct, unauthorized sharing of resources, violation of third-party platform rules, or infringement of another person’s rights.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules, except where federal law or applicable consumer protection law requires otherwise. Before filing a claim, you agree to contact us and attempt to resolve the issue informally.
To the fullest extent permitted by law, disputes must be brought individually and not as a class action, collective action, consolidated action, or representative action. Any claim must be brought within one year after it arose unless a longer period is required by law.
18. Changes to These Terms
We may update these Terms from time to time. When we do, we may change the effective date above. Continued use of our website, services, classes, products, downloads, or materials after updates are posted means you accept the updated Terms.
